If you employer does not provide you with a list of company designated physicians, you are free to treat with any doctor of your own choice. Even if you are required to see the company doctor for the first 90 days of treatment, after that you may treat with any doctor of your own choice.

That right to treat with your own doctors continues until either the insurance is successful in convincing a workers’ compensation Judge that all of your benefits should be stopped or the insurance company receives a favorable ruling from a Utilization Review Organization doctor who gives an opinion that your continued treatment is neither reasonable or necessary.

In addition, there are situations where the insurance company takes the position that your treatment is not related to the original injury. That is why it is extremely important that the description of your work injury on the Notice of Compensation Payable accurately describes the injury you sufferred.

The amount of benefits is calculated based on a formula using Medicare reimbursements. However, you should be aware that no medical provider can bill you for the difference if the doctor is not fully paid.
