In a case that appears to be one of first impression, the Pennsylvania Appellate Court addressed the issue of whether a co-worker who was helping another worker was in the course and scope of his employment which had been contested by the employer and their workers’ compensation insurance carrier. 

The facts demonstrated that the claimant, in response to a call for help, went to the aid of another and sustained injuries as a result of attempting to render emergency care, and pursuant to 77 Pa. Stat. Ann. § 1031(a)(10), attempts to render aid to another did not, in and of themselves, constitute an abandonment of employment.
