Teacher-Student Sexual Abuse: Wrongs, Rights and Remedies

When your son or daughter has been sexually abused by a teacher, you need to know your rights and what can be done about them.

Over the recent past, the law has made clear the rights and remedies available to child victims of abusive teachers, both under state negligence law and state and federal statutes. There have been successful claims under the following causes of action:

1. Claims of assault, battery, and other intentional torts (wrongs) under state tort law against the offending teacher.

2. A school district may be held liable for authorizing or ratifying the teacher’s conduct. [Read more…]

Monahan Law Practice Announces Two Settlements in Clergy Abuse Cases Against Philadelphia Archdiocese

John Doe 187 issues public statement of his sexual abuse by Father William Ayres

In a public statement by the survivor of sexual abuse by priest and seminarian William Ayres of the Philadelphia Archdiocese was issued in the aftermath of a historic settlement, the first since the Philadephia District Attorney’s office published its scathing Grand Jury Report in January 2011.  That Report was in follow up to the DA’s previous report in 2005.  As noted, officials of the Archdiocese were condemned by their failures to heed the warnings of the 2005 Grand Jury Report.  In addition, in another first in the United States, Monsignor William Lynn, was criminally charged as result of these findings.

The Use of Pseudonyms in Civil Suits Over Sexual Abuse by Dan Monahan

After litigating numerous cases involving the sexual abuse of children by clergy within the Archdiocese of Philadelphia, I encountered a procedural matter that was of great concern to many of my client, and one that had no real way of dealing with it within the Pennsylvania or Philadelphia Rules of Civil Procedure.

Therefore, I decided to write an article which was published by The Legal Intelligencer, the oldest legal publication in the United States and the primary source of legal news within the Commonwealth of Pennsylvania.  In the article I outline the difficulties and hurdles that lawyers face when dealing the the sensitive nature of these matters and the plaintiffs’ desire for privacy.

The article calls upon the Court to consider codifying the Rules of Civil Procedure to bring clarity to an important aspect of filing these cases. [Read more…]

Dan Monahan Speaks to Bikers Against Child Abuse

Dan Monahan and Tammy Lerner spoke to Bikers Against Child Abuse in Mechanicsburg, Pennsylvania.  This organization provides support across the eastern part of the United States to victims of child sexual abuse including attending criminal hearings with survivors as a support system.  Tammy Lerner is an incest survovor and founding member and Vice President of the Foundation to Abolish Child Sex Abuse which works to change antiquated statutes of limitations law that protect perpetrators.
