Why Congress is Causing Truck Accidents More Likely, and More Dangerous

I don’t know about everyone, but when I am traveling on Pennsylvania or Philadelphia roads, trucks scare me. They’re huge, seem to ignore speed limits, I can’t see the driver, and there are so many of them that often times I feel boxed in a convoy of trucks which I can’t avoid. It frightens me to think what could happen to me and my family in a collision with one of these monsters. As a truck accident lawyer in Pennsylvania and Philadelphia, I have seen the consequences of these horrific accidents.

Several years ago I represented a young man who was working construction on the Pennsylvania Turnpike when a tractor trailer driver fell asleep at the wheel, crashing into my client’s parked vehicle. He suffered irreparable brain damage.

As an Op-Ed in the New York Times recently pointed out, these accidents are going to continue to happen unless Congress stops coddling the trucking industry. [Read more…]

Chester County Courthouse Shooting: Who really is the victim of crime and who deserves civil justice?

While the full details of today’s shooting at the entrance to the Chester County Courthouse and Justice Center have not been vetted, questions will have to be answered whether the sheriff department’s officer who fatally shot a man who brandished a knife and stabbed another officer in the arm and hand were justified in their response.

As the great grandson, grandson, and brother of police officers, I understand the dangers of the job. Nevertheless, as a lawyer and advocate for crime victims, individuals injured or killed in such instances are themselves the victims of assault and battery and should follow the investigation and seek representation to determine whether any federal civil rights of the victim have been violated.

We do not know all the details of the incident at the Court House, but the survivors of Curtis Smith also will need answers, and questions about his mental stability, given his previous attempt to climb over the White House fence will be just one avenue to examine.

Bus Accident that Kills Pedestrian Raises Issues of Punitive Damages

The tragic story of a pedestrian who was struck by a tour bus and dragged 50 feet that resulted in his death was made even more egregious when the bus driver left the scene of the accident without stopping.  Such outrageous conduct on the part of a private bus company raises serious questions about the viability of a punitive damage claim.  This accident brings back haunting memories for me since my grandfather was similarly struck while walking in Manhatten where he had been a police officer for over 30 years.  Although he did not die immediately, his eventual committment to a nursing home was believed to be related to the accident and his pre-mature death at age 68.

Call Your Congressman Today to Express Your Concern About Making Highways Less Safe

In June 2015 the United States House of Representatives passed a bill that would allow bigger trucks with overworked drivers behind the wheel of our nation’s highways.

I don’t know about you, but it is often times frightening to be driving on the interstate during the summer vacation period when a monster truck with a faceless driver is climbing up your back, and you have no place to go because two other monster trucks are blocking your ability to change lanes.  This is especially true on the Pennsylvania Turnpike with its narrow two lanes on many portions of the road, and more so when I travel to New York and New England and I have to take the New Jersey Turnpike. (and that doesn’t even count the times that Governor Christie shuts down the toll booths!)

Safety Concerns Raised for Stretch Limousines

While many people may assume that renting a limousine for a night of partying may be the safe alternative to driving while intoxicated, a new report reveals that stretch limousines may lack many of the structural safety features that ordinary passenger cars have.

A recent tragic accident that resulted in the death of four young women on a wine tasting tour exposed how stretch limousines present particular safety issues.  It turns about that many limousines, after they are sold by the manufacturer, are stripped of the very safety features intended to help people in regular cars survive broadside collisions.  Although manufacturers must prove that it can meet federal safety standards, after it has been bought, the new owner can modify it into a stretch limo without having to show that it is crashworthy.
